释义	法律分析：一般没有提前的规定，拖后不超过一个月。自用工之日起满一年不与劳动者订立书面劳动合同视作签订无固定期劳动合同，用人单位单方面解除劳动合同，若劳动者无过错情况下，用人单位属于违规解除劳动合同，需要按照《劳动合同法》第47条规定的经济补偿标准的二倍向劳动者支付赔偿金。法律依据：《劳动合同法》47条规定经济补偿按劳动者在本单位工作的年限，每满一年支付一个月工资的标准向劳动者支付。六个月以上不满一年的，按一年计算;不满六个月的，向劳动者支付半个月工资的经济补偿。
