释义	法律分析：违约不构成不当得利。依据我国法律规定，没有合法根据，取得不当利益，造成他人损失的，应当将取得的不当利益返还受损失的人。不当得利就是没有合同依据取得不当的利益并且造成了他人的损失。法律依据：《中华人民共和国民法典》第九百八十五条得利人没有法律根据取得不当利益的，受损失的人可以请求得利人返还取得的利益，但是有下列情形之一的除外：（一）为履行道德义务进行的给付；（二）债务到期之前的清偿；（三）明知无给付义务而进行的债务清偿。
