释义	法律分析：网上赌博属于一种违法行为，原则上也会被抓。根据参与赌博的个人的主观目的和客观行为，定性也不同。如果存在营利为目，数额较大的，违反治安管理处罚法的规定，给予罚款和拘留。如果聚众赌博，开设赌场等，则构成犯罪，追究刑事责任，判处刑罚。法律依据：《中华人民共和国治安管理处罚法》第七十条以营利为目的，为赌博提供条件的，或者参与赌博赌资较大的，处五日以下拘留或者五百元以下罚款；情节严重的，处十日以上十五日以下拘留，并处五百元以上三千元以下罚款。
