释义	对于犯罪中止，没有造成损害的，应当免除处罚;造成损害的，应当减轻处罚。在法律上承认的犯罪中止必须具备以下的特征：1、犯罪的行为人自己主观上放弃或者中止了继续犯罪的想法;2、犯罪行为人不仅有中止犯罪的想法，同时中止了继续犯罪的行为;3、中止犯罪必须是发生在行为人犯罪的过程中，而不是犯罪之外的其他过程中;4、犯罪中止必须是行为人有效停止了犯罪的行为同时避免了一些更严重的结果。法律依据《中华人民共和国刑法》第二十四条
