释义	父母是未成年子女的监护人，只有被法院撤销监护资格才会失去监护权。如果父母已故或无法担任监护人，则由祖父母、兄姐或其他有资格的人担任，但需经当地居委会或民政部门同意。父母不可放弃监护权。只有监护人被法院撤销监护资格，监护权才会消失。我国法律规定，父母是未成年子女的监护人。如果未成年人的父母已经死亡或者没有监护能力，监护人将由以下有监护能力的人按顺序担任：（一）祖父母、外祖父母；（二）兄、姐；（三）其他愿意担任监护人的个人或组织，但必须获得未成年人住所地的居民委员会、村民委员会或民政部门的同意。《民法典》第二十七条，父母是未成年子女的监护人。未成年人的父母已经死亡或者没有监护能力的，由下列有监护能力的人按顺序担任监护人：（一）祖父母、外祖父母；（二）兄、姐；（三）其他愿意担任监护人的个人或者组织，但是须经未成年人住所地的居民委员会、村民委员会或者民政部门同意。该内容由信金国律师和家和律云共创回答
