释义	确认合同无效是法院的职权，法院应该直接依据法律的规定，行使该项职权。所以不论是不是合同当事人都不能确认合同无效，只能是主张合同无效，然后申请由法院确定。如果是第三人请求确认合同无效的，必须以原告的身份起诉。【本文关联的相关法律依据】《民法典》第一百五十三条，违反法律、行政法规的强制性规定的民事法律行为无效。但是，该强制性规定不导致该民事法律行为无效的除外。违背公序良俗的民事法律行为无效。（《民法典》生效时间为2021年1月1日）。
