释义	本罪在主观方面表现为故意，且是直接故意，即明知是毒品而走私、贩卖、运输、制造，过失不构成本罪。如果行为人主观上不明知是毒品，而是被人利用而实施了走私、贩卖、运输、制造的行为，就不构成犯罪。一般是以营利为目的，但也不能排除其他目的，法律没有要求构成本罪必须以营利为目的。走私、贩卖、运输、制造毒品罪，是指明知是毒品而故意实施走私、贩卖、运输、制造的行为。【本文关联的相关法律依据】《刑法》第347条，走私、贩卖、运输、制造毒品，无论数量多少，都应当追究刑事责任，予以刑事处罚。
