释义	法律分析: 对方出轨，不能告小三坐牢，除非小三构成重婚罪。法律规定，一般的出轨行为不是违法犯罪行为，不可以通过法律途径解决配偶和小三的出轨问题，但是如果配偶和小三登记结婚或者在外以夫妻名义同居，那么当事人就可以以二人构成重婚罪为由追究其刑事责任，如果小三构成重婚罪那么就要坐牢。法律依据: 《中华人民共和国民法典》第一千零四十二条禁止包办、买卖婚姻和其他干涉婚姻自由的行为。禁止借婚姻索取财物。禁止重婚。禁止有配偶者与他人同居。禁止家庭暴力。禁止家庭成员间的虐待和遗弃。
