释义	根据《社会保险法》规定，为使劳动者在年老、患病、工伤、失业、生育等情况下获得帮助和补偿，国家发展社会保险事业，建立基本养老保险、基本医疗保险、工伤保险、失业保险、生育保险等社会保险制度，设立社会保险基金。用人单位为劳动者办理社会保险登记，并按时足额缴纳社会保险费，系用人单位按照法律规定应当履行的强制性的法律义务，用人单位必须依法履行。用人单位不得通过发放社保补贴的形式代替缴纳社会保险。法律依据《中华人民共和国劳动法》第七十条
