释义	一般情况下，工商登记的法定代表人具有推定效力，即在无相反证据证明法定代表人不能代表公司意志的情况下，默认法定代表人代表公司参与诉讼。但如持公章的人能提供公司明确所持公章才能代表公司意志的有效授权证据，即可推翻法定代表人代表公司意志参与诉讼，此时，可认定持章人为诉讼代表人。法律依据：《民事诉讼法》第四十八条公民、法人和其他组织可以作为民事诉讼的当事人。法人由其法定代表人进行诉讼。其他组织由其主要负责人进行诉讼。
