释义	法律分析: 诉讼代理人不是当事人。诉讼代理人是指受当事人委托，以委托人的名义在代理的权限内进行诉讼活动的人。其诉讼行为产生的法律后果由被代理人承担。凡是超越代理权所实施的诉讼行为，都是无效的诉讼行为，不能产生法律上的效果。《中华人民共和国民法典》第一百六十一条民事主体可以通过代理人实施民事法律行为。依照法律规定、当事人约定或者民事法律行为的性质，应当由本人亲自实施的民事法律行为，不得代理。
