释义	法律分析: 非法民间借贷是指违反法律规定的借贷行为，可能涉嫌非法集资，非法集资是指未经国务院金融管理部门依法许可或者违反国家金融管理规定，以许诺还本付息或者给予其他投资回报等方式，向不特定对象吸收资金的行为。《最高人民法院关于审理民间借贷案件适用法律若干问题的规定》第一条本规定所称的民间借贷，是指自然人、法人和非法人组织之间进行资金融通的行为。经金融监管部门批准设立的从事贷款业务的金融机构及其分支机构，因发放贷款等相关金融业务引发的纠纷，不适用本规定。
