十级伤残和是否可以办理残疾证是没有直接关系的，因为办理残疾证和伤残鉴定的标准并不一样，依据也不一样残疾证是为了享受国家给予的政策优惠伤残级别8-10级一般都办不了残疾证办残疾证的要是符合国家务院制定的《中国实用残疾人评定标准》的视力残疾、听力残疾、言语残疾、智力残疾、肢体残疾和精神残疾的人员

《中华人民共和国宪法》 第四十五条 中华人民共和国公民在年老、疾病或者丧失劳动能力的情况下，有从国家和社会获得物质帮助的权利。国家发展为公民享受这些权利所需要的社会保险、社会救济和医疗卫生事业。 国家和社会保障残废军人的生活，抚恤烈士家属，优待军人家属。 国家和社会帮助安排盲、聋、哑和其他有残疾的公民的劳动、生活和教育。
《中华人民共和国残疾人保障法》
第二十二条 残疾人教育，实行普及与提高相结合、以普及为重点的方针，保障义务教育，着重发展职业教育，积极开展学前教育，逐步发展高级中等以上教育。
第二十三条 残疾人教育应当根据残疾人的身心特性和需要，按照下列要求实施：
（一）在进行思想教育、文化教育的同时，加强身心补偿和职业教育；
（二）依据残疾类别和接受能力，采取普通教育方式或者特殊教育方式；
（三）特殊教育的课程设置、教材、教学方法、入学和在校年龄，可以有适度弹性。
