释义	大额信用卡逾期不还是有可能构成犯罪的，其实认定信用卡诈骗罪有两个必需的要件，一是经发卡银行两次催收都没有还款的；二是超过三个月没有归还。根据现行刑法第196条的相关规定，以下四种情形属于信用卡诈骗罪： 1、使用伪造的信用卡，或者使用以虚假的身份证明骗领的信用卡的； 2、使用作废的信用卡的； 3、冒用他人信用卡的； 4、恶意透支的。这里所说的恶意透支是指持卡人以非法占有为目的，超过规定限额或者规定期限透支，并且经发卡银行两次催收后超过3个月仍不归还的行为。
