释义	认定抗税罪要注意的问题：1、本罪与妨害公务罪的界限；2、区分抗税罪与一般拒不缴纳税款行为。抗税罪是负有纳税义务的人或者企业、事业单位的直接责任人员，故意违反国家税收法规，采取公开抵制、对抗的方法，拒不缴纳税款，情节严重的行为。法律依据《刑法》第二百零二条，以暴力、威胁方法拒不缴纳税款的，处三年以下有期徒刑或者拘役，并处拒缴税款一倍以上五倍以下罚金；情节严重的，处三年以上七年以下有期徒刑，并处拒缴税款一倍以上五倍以下罚金。
