释义	渎职行为只有达到情节严重或者造成重大损失时，才构成相应的渎职犯罪;犯罪行为达到情节特别严重或者造成特别重大损失时，才能对行为人处以更重的刑罚。损失金额上一般造成经济损失30万元以上可能构成本罪。渎职罪是刑法第九章章节名称是指国家机关工作人员利用职务上的便利或者徇私舞弊、滥用职权、玩忽职守，妨害国家机关的正常活动，损害公众对国家机关工作人员职务活动客观公正性的信赖，致使国家与人民利益遭受重大损失的行为。包括滥用职权罪、玩忽职守罪。法律依据《中华人民共和国刑法》第三百九十七条规定：
