释义	法律分析：雇佣关系是指受雇人向雇主提供劳务，雇主支付相应报酬形成权利义务关系。雇佣关系是雇主和受雇人达成契约的基础上成立的，雇佣合同可以是口头也可以是书面的。法律依据：《最高人民法院关于雇佣关系的相关司法解释》第九条雇员在从事雇佣活动中致人损害的，雇主应当承担赔偿责任;雇员因故意或者重大过失致人损害的,应当与雇主承担连带赔偿责任。雇主承担连带赔偿责任的，可以向雇员追偿。
