出卖人未经配偶同意买卖房屋是否有效
释义
合同有效。但如果出现配偶不同意的情况，1.如果房产登记在出卖人夫妻双方名下的，出卖人配偶不配合办理过户致使出卖人出现违约情形的，买受人可根据房屋买卖合同的约定要求出卖人承担违约责任或赔偿损失。2.如果房产登记在出卖人一人名下的，而买受人善意购买、支付合理对价并办理产权登记手续，买受人可获得房屋产权；出卖人或其配偶主张退回房屋的，人民法院不予支持。
