起诉重婚罪的时效有多长时间 |

重婚罪是指有配偶又与他人结婚或者明知他人有配偶而与之结婚的行为。重婚罪的追诉时效一般为五年。
根据刑法对追诉时效的规定，法定最高刑不满五年，经过五年不再追诉。
由于法律对重婚罪的处罚是两年以下有期徒刑或拘役，因此重婚罪的追诉时效为5年。也就是说重婚罪在经过了5年之后就不能再进行处理。
重婚罪的计算时间也就是追诉期限从犯罪之日起计算，如果这种犯罪行为持续下去，从犯罪行为终了之日起计算。根据有关法律文件规定，重婚罪的最高刑是2年有期徒刑，追诉时效为五年。但又因为，重婚往往是一个持续的状态。法律规定，犯罪行为有连续或者继续状态的，从犯罪行为终了之日起计算。
但已经立案侦察或由法院受理的案件，不受追诉期限的限制。
【法律依据】
《刑法》第八十七条，犯罪经过下列期限不再追诉：
(一)法定最高刑为不满五年有期徒刑的，经过五年;
(二)法定最高刑为五年以上不满十年有期徒刑的，经过十年;
(三)法定最高刑为十年以上有期徒刑的，经过十五年;
(四)法定最高刑为无期徒刑、死刑的，经过二十年。如果二十年以后认为必须追诉的，须报请最高人民检察院核准。
