释义	以危险方法危害公共安全的犯罪，既然属于危害公共安全罪，在认定这种犯罪时，就必须严格掌握构成危害公共安全罪的特定要件，不能盲目扩大解释，也不能任意缩小其范围，混淆罪与非罪、此罪与彼罪的界限，导致定罪不准，量刑不当。依照《刑法》第115条的规定，以危险方法危害公共安全，尚未造成严重后果的，处三年以上十年以下有期徒刑;犯本罪致人重伤、死亡或者使公私财产遭受重大损失的，处十年以上有期徒刑、无期徒刑或者死刑。法律依据《刑法》第一百一十五条
