释义	立遗嘱人必须具有立遗嘱能力。遗嘱能力，又称遗嘱处分能力，是指自然人依法享有的设立遗嘱，依法自由处分自已财产的资格。遗嘱是民事法律行为，须有相应的民事法律行为。故自然具有法律特别规定的行为能力才得设立遗嘱。即并非任何人都可设立遗嘱，只有具有遗嘱处分能力的人才有设立遗嘱的资格。【本文关联的相关法律依据】《民法典》第一千一百四十三条无民事行为能力人或者限制民事行为能力人所立的遗嘱无效。遗嘱必须表示遗嘱人的真实意思，受欺诈、胁迫所立的遗嘱无效。伪造的遗嘱无效。遗嘱被篡改的，篡改的内容无效。
