释义	企业破产是属于民事行为，涉及到企业破产的案件一般是适用民事诉讼法，但有些破产案件会涉及到刑事犯罪，适用的是刑法。《中华人民共和国企业破产法》第四条破产案件审理程序，本法没有规定的，适用民事诉讼法的有关规定。第一百二十五条企业董事、监事或者高级管理人员违反忠实义务、勤勉义务，致使所在企业破产的，依法承担民事责任。有前款规定情形的人员，自破产程序终结之日起三年内不得担任任何企业的董事、监事、高级管理人员。法律依据《中华人民共和国企业破产法》第四条、第二十条、第二十一条、第一百二十五条
