释义	法律分析: 自卫是指当自己有可能受到伤害时作出的反应，持枪肯定犯法，但遇到危险时自己身上有枪并自卫反击的话这不算，假枪要看威力多大。比如随身带一把小刀防卫这就不算犯法。法律依据: 《中华人民共和国枪支管理法》第二十六条配备公务用枪的人员不再符合持枪条件时，由所在单位收回枪支和持枪证件。配置民用枪支的单位和个人不再符合持枪条件时，必须及时将枪支连同持枪证件上缴核发持枪证件的公安机关；未及时上缴的，由公安机关收缴。
