释义	法律分析：根据我国相关法律规定，在婚姻关系存续期间，一方有虐待家庭成员等家暴情节的，如果情节恶劣，虐待罪属于亲告罪，需要被害人告诉才处理，构成虐待罪的，将被依法判处二年以下有期徒刑、拘役或者管制。如果构成虐待罪的，同时致使被害人重伤、死亡的，将被依法判处二年以上七年以下有期徒刑。法律依据：《中华人民共和国刑法》第二百六十条虐待家庭成员，情节恶劣的，处二年以下有期徒刑、拘役或者管制。犯前款罪，致使被害人重伤、死亡的，处二年以上七年以下有期徒刑。第一款罪，告诉的才处理。
