释义	法律分析：用人单位与其他单位合并的，合并前与劳动者发生的劳动争议，由合并后的单位为诉讼当事人；用人单位分立为若干单位的，其分立前与劳动者发生劳动争议，由分立后的实际用人单位为诉讼当事人。但在劳动者因用人单位不明确的情况下，即劳动者因用人单位分立为若干单位，而没有了实际用人单位时，分立后的单位均为当事人。法律依据：《公司法》第一百七十四条，公司合并时，合并各方的债权、债务，应当由合并后存续的公司或者新设的公司承继。
