新民法典关于赌博的规定
释义
治安管理处罚法规定，参与赌博只属于违法行为，不属于犯罪行为。参与赌博的人只会被依据治安管理处罚法进行处罚。我国相关法规规定，参与赌博的，会被处五天以下的拘留或者被罚五百元以下的罚款；如果犯罪情节严重的，不仅会被处十天以上十五天以下的拘留，还会处五百元以上三千元以下的罚款。法律依据：《中华人民共和国治安管理处罚法》第七十条规定，以营利为目的，为赌博提供条件的，或者参与赌博赌资较大的，处五日以下拘留或者五百元以下罚款；情节严重的，处十日以上十五日以下拘留，并处五百元以上三千元以下罚款。
