释义	过失犯罪不能构成累犯。根据《刑法》第六十五条规定，被判处有期徒刑以上刑罚的犯罪分子，刑罚执行完毕或者赦免以后，在五年以内再犯应当判处有期徒刑以上刑罚之罪的，是累犯，应当从重处罚，但是过失犯罪和不满十八周岁的人犯罪的除外。由此可见，构成累犯的条件之一必须是前罪与后罪都属于故意犯罪，过失犯罪的主观恶意明显轻于故意犯罪，而且过失犯罪人再犯罪的可能性也比较小。所以，过失犯罪不能构成累犯。法律依据《中华人民共和国刑法》第十四条、第十五条、第六十五条
