释义	原劳动部办公厅《关于处理劳动争议案件几个问题的复函》（劳办发〔1997〕15号）的规定，未经仲裁程序直接进入诉讼程序的劳动争议案件，当事人又向劳动争议仲裁委员申请仲裁，如果是当事人就该劳动争议提起诉讼又撤诉的，或者人民法院书面裁定先由仲裁委员会受理的，只要该劳动争议符合受理条件，仲裁委员会应予受理；如果是人民法院正在对该劳动争议进行审理或者对实体内容作出调解、裁定或判决，仲裁委员会则不予受理。
