释义	孕妇盗窃被警方抓获后，由于警方依照相关法律不能收监、拘留孕妇和哺乳期妇女，只好根据案情对其作出取保候审或者治安处罚不予执行的决定。到了检察机关或者法院层面，也是取保候审，即便判了刑，也会追加缓刑，当事人可申请监外执行。通俗地说，不管取保候审还是监外执行，人放了，人身自由还在，因此，个别孕妇就利用这一点屡犯屡盗。一般盗窃如果数额较小孕妇会获缓刑。在犯罪情节严重、涉案金额较大的情况下，根据相关法律可以判处实刑，但犯罪嫌疑人也能申请监外执行。
