释义	放火罪和失火罪是两个由不同主观心态引起的、处罚力度完全不同的犯罪。一个属于故意犯罪，一个属于过失犯罪。对于过失引起的「失火罪」，按照我国《刑法》第115条的规定，处3年以上7年以下有期徒刑；情节较轻的，处3年以下有期徒刑或者拘役。而对于故意引起的「放火罪」，我国《刑法》第114条的规定，放火、或者以其他危险方法危害公共安全，尚未造成严重后果的，处三年以上十年以下有期徒刑。致人重伤、死亡或者使公私财产受到严重损害的，处十年以上有期徒刑、无期徒刑或者死刑。
