释义	如果录音证据是通过合法方式收集的，则具有法律效力。首先，录音或录像证据是法律允许的证据形式之一。在《民事诉讼法》第63条规定了八种形式的证据，其中第四项是“视听资料”也就是录音录像证据。在《继承法》中，也有“录音遗嘱”的规定。所以，视听资料是法律允许的证据形式。但录音证据如果是非法取得的，是不能作为有效证据使用的。比如采取在他人居所、工作场所等安置偷录设备，或者是采取其他非法手段取得视听证据，这就属于非法取得，证据无效。
