释义	代孕是违法的。代孕行为是属于《民法总则》规定的违反公序良俗行为的，其法律效力是无效的。所以，即使签订了代孕相关的合同，或者达成代孕合意的，也是无效的，不产生法律效力，也不受法律保护。法律依据：《人类辅助生殖技术管理》第三条（一）人类辅助生殖技术的应用应当在医疗机构中进行，以医疗为目的，并符合国家计划生育政策、伦理原则和有关法律规定。（二）禁止以任何形式买卖配子、合子、胚胎。医疗机构和医务人员不得实施任何形式的代孕技术。
