合同成立与合同生效的区别有什么 |

法律分析：
1、内容判断上不一致。合同的成立是指合同订立过程的完成，也即主体对合同的基本内容达成一致意见。合同的生效则指依法成立的合同为使其具有法律所赋予的约束力而产生的效力。
2、成立和生效适用规则不同。合同的成立适用意思自治原则，当事人有从事合同行为的意志自由，可以自由地选择合同的相对人、订立的形式和合同的内容，依其自由意志创设权利义务关系。
而合同的生效必须在国家的干预下，依法判断合同是否合乎法律，只有合法的合同才能有效。
法律依据：
《中华人民共和国民法典》 第五百零二条 依法成立的合同，自成立时生效，但是法律另有规定或者当事人另有约定的除外。
依照法律、行政法规的规定，合同应当办理批准等手续的，依照其规定。未办理批准等手续影响合同生效的，不影响合同中履行报批等义务条款以及相关条款的效力。应当办理申请批准等手续的当事人未履行义务的，对方可以请求其承担违反该义务的责任。
依照法律、行政法规的规定，合同的变更、转让、解除等情形应当办理批准等手续的，适用前款规定。
