释义	最高人民法院关于适用《中华人民共和国企业破产法》若干问题的规定（二）第十三条:破产申请受理后，管理人未依据企业破产法第三十一条的规定请求撤销债务人无偿转让财产、以明显不合理价格交易、放弃债权行为的，债权人依据合同法第七十四条等规定提起诉讼，请求撤销债务人上述行为并将因此追回的财产归入债务人财产的，人民法院应予受理。相对人以债权人行使撤销权的范围超出债权人的债权抗辩的，人民法院不予支持。
