释义	签订购房合同后，如果无法办理按揭贷款，需要区分以下情况进行处理：合同对此有约定的，按约定处理。合同没有约定的，如果是因购房人的责任造成的，无权要求返还定金;如果是因卖房人责任的，卖房人要双倍返还定金。当事人可以约定一方向对方给付定金作为债权的担保。债务人履行债务后，定金应当抵作价款或者收回。给付定金的一方不履行约定的债务的，无权要求返还定金;收受定金的一方不履行约定的债务的，应当双倍返还定金。法律依据《民法典》第五百八十七条
