释义	老板破产后要坐牢吗公司申请破产法定代表人不会坐牢的。但是如果公司经营过程中存在违反《公司法》规定的行为，如虚假出资，抽逃出资，虚报注册资本、偷税逃税等行为的，情节严重的，需要依法追究其刑事责任。不能清偿到期债务且公司的全部资产已不足以清偿全部债务的，债务人可向法院申请破产，公司在区工商部门登记的，应向区法院申请。公司破产后，如果法定代表人对破产负有责任的，在三年内不得再担任公司高管。
