释义	法律分析：不当得利案件根据民事诉讼法的规定应由被告所在地的法院管辖，只有对涉及不动产的案件才由不动产所在地的法院管辖。它与一般的民事案件管辖地的确定是相同的。其一般情况下都是由基层人民法院管辖。法律依据：《中华人民共和国民法典》第九百八十五条得利人没有法律根据取得不当利益的，受损失的人可以请求得利人返还取得的利益，但是有下列情形之一的除外：（一）为履行道德义务进行的给付；（二）债务到期之前的清偿；（三）明知无给付义务而进行的债务清偿。
