释义	法律分析：集体土地使用权不得出让、转让或者出租用于非农业建设，但是符合土地利用总体规划并依法取得建设用地的企业因破产、兼并等情形致使土地使用权依法发生转移的除外。法律依据：《中华人民共和国城市房地产管理法》第二十三条土地使用权划拨，是指县级以上人民政府依法批准，在土地使用者缴纳补偿、安置等费用后将该幅土地交付其使用，或者将土地使用权无偿交付给土地使用者使用的行为。依照本法规定以划拨方式取得土地使用权的，除法律、行政法规另有规定外，没有使用期限的限制。
