释义	对违反规定，擅自从事保险代理业或者经纪业务的，应当依照保险法的规定承担下列行政责任和刑事责任： 1.行政责任。对未依法取得经营保险代理业务许可证或者经纪业务许可证，非法从事保险代理业务或者经纪业务的，由金融监督管理部门予以取缔，没收违法所得，处以违法所得5倍以上10倍以下的罚款。 2.刑事责任。对未依法取得经营保险代理业务许可证或者经纪业务许可证，非法从事保险代理业务或者经纪业务活动，构成犯罪的，依照刑法关于破坏金融管理秩序罪的有关规定追究刑事责任。
