释义	根据刑法第78条的规定，减刑分为两种情况：一是可以减刑，即具备一定条件时，人民法院可以裁定减刑。二是应当减刑，即有重大立功表现时，人民法院应当减刑。从减刑的方法与效果来看，减刑也分为两种情况：一是将无期徒刑减为有期徒刑，这是刑种的变更;二是将管制、拘役、有期徒刑的刑期减少，不能变更刑种。减刑不同于改判。改判是指原判决有错误，撤销原判决而重新作出判决;改判的结果是多种多样的。减刑并不改变原判决，而是在肯定原判决的基础上，基于法定原因将原判决的刑罚予以减轻。减刑与减轻处罚的区别则更为明显。
