释义	法律分析：公司没有和劳动者签订劳动合同的，劳动者可以提出辞职报告随时离职，公司不能以此扣押工资，应结清所有拖欠工资以及加班工资。法律依据：《中华人民共和国劳动合同法》第四十条应当订立劳动合同而未订立的，劳动者可以随时终止劳动关系。同时作为对于劳动者的保护，应当订立劳动合同而未订立的，用人单位提出终止劳动关系，应当提前三十日通知劳动者。
