释义	保险公司经人民法院宣告破产后，由人民法院组织保险监督管理机构等有关部门和有关人员组成清算组，进行清算。清算程序依照《企业破产法》或《民事诉讼法》规定的破产还债程序进行。【法律依据】根据《保险法》第八十九条的规定，破产财产在优先支付破产费用后，按照下列顺序清偿：(1)所欠职工工资和劳动保险费用;(2)赔偿或者给付保险金;(3)所欠税款;(4)清偿公司债务。破产财产不足清偿同一顺序清偿要求的，按照比例分配。
