释义	法律分析：区分盗窃罪与侵占罪的关键，在于判断作为犯罪对象的财物是否脱离占有以及由谁占有。行为人不可能盗窃自己事实上占有的财物，对自己事实上已经占有的财物只能成立侵占罪。侵占罪的特点是将自己占有的财产不法转变为所有，因此，只要某种占有具有被处分的可能性，便属于侵占罪中的代为保管，即占有。法律依据：《中华人民共和国刑法》第二百六十四条盗窃公私财物，数额较大的，处三年以下有期徒刑、拘役或者管制，并处或者单处罚金。盗窃罪是将他人占有的财物通过和平的手段转移为自己占有。
