刑拘后需要走的程序如下：刑拘后，公安机关认为被拘留者需要逮捕的，应当在拘留后三日内提交人民检察院审查批准。人民检察院应当在接到公安机关批准逮捕书后七日内决定批准或者不批准逮捕。人民检察院不批准逮捕的，公安机关应当自接到通知后释放犯罪嫌疑人，并立即将其执行情况通知人民检察院。对于需要继续调查并符合取保候审或者监视居住条件的，应当依法予以取保候审或监视居住。刑事诉讼分为三个阶段：调查，起诉和审判。分别由公安，检察院和法院主导。刑事拘留属于调查阶段，最长拘留期限为37天。期限届满后，有关机构将根据情况决定采取哪些强制措施，例如逮捕，取保候审和监视居住。

第一百六十三条 在侦查过程中，发现不应对犯罪嫌疑人追究刑事责任的，应当撤销案件；犯罪嫌疑人已被逮捕的，应当立即释放，发给释放证明，并且通知原批准逮捕的人民检察院。
第一百六十五条 人民检察院直接受理的案件中符合本法第八十一条、第八十二条第四项、第五项规定情形，需要逮捕、拘留犯罪嫌疑人的，由人民检察院作出决定，由公安机关执行。
第一百六十九条 凡需要提起公诉的案件，一律由人民检察院审查决定。
