释义	法律分析：法律上重婚罪不知情的小三不会判刑。有配偶者的小三与他人同居的、无配偶者的小三明知他人有配偶仍与其同居的均构成重婚罪，应当依法判刑追究刑事责任。构成重婚罪的，处二年以下有期徒刑或者拘役，依法追究刑事责任；当事人为现役军人配偶的，处三年以下有期徒刑或者拘役。法律依据《刑法》第二百五十八条有配偶而重婚的，或者明知他人有配偶而与之结婚的，处二年以下有期徒刑或者拘役。《刑法》第二百五十九条明知是现役军人的配偶而与之同居或者结婚的，处三年以下有期徒刑或者拘役。
