释义	《婚姻法》第四十一条“离婚时，原为夫妻共同生活所负的债务，应当共同偿还。”最高人民法院《关于人民法院审理离婚时处理财产分割问题的若干具体意见》指出，夫妻共同债务包括以下几个方面：（1）因日常生活所负的债务；（2）因生产经营活动所负的债务；（3）夫妻一方或双方治疗疾病所负的债务；（4）因抚养子女所负的债务；（5）因赡养有赡养义务的老人所负的债务；（6）其他应认定为夫妻共同债务的债务。夫妻共同债务，应当由夫妻共同财产偿还，共同财产不足偿还的，从夫妻个人所得财产偿还。
