释义	诉讼费一般由败诉方承担，律师费由请律师的一方出。但是在民商事案件中，当一方成为被告以后，该方聘请律师为其辩护并且胜诉原告的话，可以要求原告支付这笔费用(法律支持一方当事人偿付他方当事人为案件审理而支付的必要费用)。其根据《诉讼费用交纳办法》第六条，当事人应当向人民法院交纳的诉讼费用包括：(一)案件受理费；(二)申请费；(三)证人、鉴定人翻译人员、理算人员在人民法院指定日期出庭发生的交通费、住宿费、生活费和误工补贴。
