未履行合同怎样起诉 |

一、确定管辖法院：因合同纠纷提起的诉讼，由被告住所地或者合同履行地人民法院管辖。二、当事人起诉，首先应提交起诉书，并按对方当事人人数提交相应份数的副本。三、根据“谁主张谁举证”原则，原告向法院起诉应提交下列材料：四、当事人向法院提交书证，应填写一式两份证据清单，详细列明提交证据的名称、页数。证据经法院承办人核对后，由承办人在证据清单上签字盖章，一份交当事人，一份备案。五、立案庭在当事人履行必须的手续和交齐有关证据材料之后，在七天内，对符合立案条件的，办理立案手续;对不符合立案条件的，依法裁定不予受理。六、当事人应在收到受理通知书之日起七天内预交案件受理费和其他诉讼费用。七、立案手续后，案件由法院排期开庭，当事人应服从法院的各项工作安排，并于结案后到财务室结算诉讼费用，多退少补。法律依据：《中华人民共和国民事诉讼法》第二十一条对公民提起的民事诉讼，由被告住所地人民法院管辖;被告住所地与经常居住地不一致的，由经常居住地人民法院管辖。对法人或者其他组织提起的民事诉讼，由被告住所地人民法院管辖。同一诉讼的几个被告住所地、经常居住地在两个以上人民法院辖区的，各该人民法院都有管辖权。
