释义
界定外观专利侵权行为应当符合以下要件：一、侵犯的对象应当是在我国享有专利权的有效专利。二、有违法行为存在。即行为人未经专利权人许可，有以营利为目的实施专利的行为。三、行为人主观上有过错。侵权人主观上的过错包括故意和过失。四、应以生产经营为目的。
