释义	房屋租赁协议违约金应该付多少 (1)违约金由双方协商确定，没有数额的限制，一般是根据双方预测的因一方违约可能带来的损失大小来确定的。 (2)发生一方违约后、守约方要求违约方承担违约责任时，如果约定的违约金“低于”实际发生的损失，守约方可以起诉到法院请求增加违约金;如果约定的违约金“过分”高于实际损失，违约方可以起诉到法院请求减少违约金。 (3)“不超过20%”，应是指不超过主合同标的额的20%，但这只能适用于定金约定，约定的定金高于主合同标的额20%的部分，法院不会支持。
